Pakistan’s administration has done a big thing with social media application registration. A new policy framework was developed that requires telecommunications services to be licensed and registered. This license will last fifteen years.
Regulation of Social Media and Online Services
Under the new framework, this includes online gaming platforms such as Twitter, Facebook, LinkedIn, and e-commerce. Popular communication platforms, including WhatsApp, Skype, Facebook Messenger, IMO, and Viber, must also have licenses to operate in Pakistan.
The government is fast-tracking efforts to regulate over-the-top (OTT) services as part of the “Great Firewall of Pakistan” initiative. The Pakistan Telecommunication Authority (PTA) has finalized its consultations with all relevant stakeholders. The framework is scheduled to go before the federal cabinet for approval.
Categorization of Services
The law of media and virtual offerings might be collectively overseen by using PTA. And PEMRA (Pakistan Electronic Media Regulatory Authority). The OTT offerings are labeled into 3 classes: Communication Services. Application Services and Media Services.
Communication Services: These include platforms like WhatsApp, Facebook Messenger, IMO, Skype, Viber, etc., which enable users to communicate with each other.
Application Services: This category will include X (formerly known as Twitter) and Facebook, among others that fall under these main categories comprising e-commerce & gaming LinkedIn, among others.
Media Services: Otherwise referred to as non-broadcasting services, such as YouTube, Netflix, Spotify, or Video-On-Demand platforms, are among Non-Broadcasting Services, while Broadcasting Services refer to social media platforms operated by Pakistani television channels only.
Regulatory Framework and Compliance
The whole regulatory framework will be established under the PECA Act 2016, the PEMRA Ordinance 2002, and the PTA Act 1996. PTA regulations will apply to all internet-connected services, including OTT application services. PTA laws should also govern communication platforms, and if approved, all social media platforms must register and get licenses with the authority within one year.
The policy will require compliance with local laws, content protection, and privacy standards. In case of disputes, the platforms will have to submit relevant content to the appropriate agency or officer. Additionally, companies must keep data within Pakistan. License holders will need to provide location and general information during emergencies.
OTT application services must adhere to PECA laws while media services will be required to comply with PECA Act as well as other related regulations. OTT broadcasting services fall under PEMRA Ordinance 2002 and PECA laws. There is an addition of new framework for non- broadcasting services as well.
