What is Dowry and How is the Amount Determined?

Section 323 of the Pakistan Penal Code outlines the Diyat amount’s criteria. The court is responsible for setting this amount, considering the financial conditions of the offender and the victim’s family. The law stipulates that the minimum Diyat must equal the value of 30,630 grams of silver.

Each year, the government issues a notification specifying the value of 30,630 grams of silver. Which determines the minimum Diyat amount. This approach ensures that the Diyat reflects current economic conditions and maintains its relevance as compensation.

Current Diyat Amount in Pakistan

In Pakistan, the federal authorities determine the Diyat quantity at the start of every 12 months, with the cabinet’s approval. The authorities have yet to announce the amount of Diyat for the current economic year. However, for the previous financial year, which began on August 22, 2023, the caretaker government set the Diyat at Rs. 6,757,902, primarily based on the fee of 30,630 grams of silver.

The market value of 30,630 grams of silver stands at Rs. 8,049,564, reflecting an increase in silver prices. Despite these fluctuations, the final determination of the Diyat amount remains within the federal government’s jurisdiction. Which adjusts it according to economic conditions.

Diyat provides an alternative to the death penalty in Pakistan, offering offenders a means to seek forgiveness through financial compensation. The legal framework surrounding Diyat ensures fairness and equity by annually adjusting its amount to reflect changes in the value of silver. This system underscores the importance of financial justice and reconciliation in the context of serious crimes.
