In order to curb dangerous practices, the Punjab Government has declared kite flying, kite manufacturing, and kite transportation non-bailable offences. This decision is part of a larger effort by authorities to manage the risks associated with these activities. Which have seen many accidents and deaths over time.
Legal Amendments Punjab
According to an official from the Punjab’s home department, production, usage or transportation of kites, metallic string wire, and strings coated with abrasive materials have been declared criminal acts in the state. These were recently approved by the Punjab Cabinet, amending laws of 2007 banning kite-flying during certain seasons. Still, this time, stricter penalties will be imposed on any person found breaking such law.
Penalties for Kite Flyers Punjab
According to the new amendment, individuals caught flying kites may face imprisonment from three up to five years plus a fine up to 2 Million Rupees or both at once; if someone doesn’t pay that much money, then he shall be imprisoned for one more year additionally, as per this modification. These measures are strict because they reflect how serious the government is about preventing accidents due to flying kites, especially those with metal wires, which could cause serious injuries or even fatalities.
Penalties for Manufacturers and Transporters
The law also provides heavy punishment against manufacturers as healthy carriers (transporters) involved in making illegal kites, including its substances like thread rolls, etcetera; therefore, any individual found guilty hereof can get jailed between five to seven years alongside paying an extra fine not exceeding Five Million Rupee otherwise either thereof. To ensure no escape route through not paying fines, two more years will be added behind bars if only the initial sentence hasn’t been cleared off through payment within a stipulated period after conviction under relevant sections dealing with such matters according to our penal code act. Hence, it disrupts the supply chain network relating to unlawful productions plus logistics services concerning hazardous games called ‘kite.’
Minors’ Penalties
There are special provisions for minors engaged in flying kites. A first-time offence by a minor will attract a warning. In contrast, the second time shall attract a fine of Fifty Thousand Rupees. And in case of a third violation, the amount doubles to One Hundred Thousand Rupees. Which will be recovered from parents or guardians if such minor can’t pay. Fourth act shall be punished under Juvenile Justice System Act 2018 meaning that there could be imprisonment as well.
Government’s Position
The government’s position was explained through official words saying these measures are aimed at saving lives. And stopping dangerous acts that have led many people to lose their lives due to accidents caused by metal-stringed kites during this period. When wind is blowing at high speeds. The reason behind setting higher penalties. And fines is to discourage individuals from participating in hazardous events so as to safeguard the lives of the general public.
This move by the authorities reflects their commitment towards enforcing these laws more strictly to to prevent future tragedies. And ensure overall safety within the Punjab province for all its citizens without further delay.
