PTI Founder Files Complaint Against Chief Justice Farooq

 

A recent noteworthy event in Pakistan is the founder of the movement, Tehreek-e-Insaf (PTI), Imran Khan, filing an official complaint against Chief Justice Aamer Farooq of Islamabad High Court. The central allegation concerns the misuse of judicial authority while dealing with cases related to PTI’s chief.

The accusation revolves around Justice Aamer Farooq’s supposed abuse of Farooq’s powers as a judge when handling cases involving PTI’s leader. Since assuming office on November 11th this year, the computist has taken an unprecedented interest in the petitioner’s legal matters.

He has handled nearly all issues connected with the petitioner, including those filed or pending before various benches, such as those with Mr. Justice Mohsin Akhtar Kayani at the Lahore Registry.

The applicant also believes that this behavior on the part of the Hon’ble Chief Justice be incidental but intentionally aimed at affecting the outcomes of these complaints by combining them all under one roof to deny justice based solely on convenience, thereby raising doubts over the impartiality fairness process adopted towards petitioners seeking relief from perceived unconstitutional acts committed against their rights guaranteed under Constitution 1973 read with fundamental freedoms enshrined therein binding upon State organs including judiciary itself being custodian thereof such as right to free fair trial within a reasonable time before the competent court.

The petitioner alleges that most, if not all, cases filed by or against the client within the Punjab province have been assigned to either Justice Aamer Farooq’s or a bench that includes him. The petitioner argues that this amounts to abuse of power, indicating premeditation and malice by Justice Aamer Farooq.

The petitioner seeks an inquiry into complaints about any judge’s integrity, misconduct, impropriety, or incapacity, including the Chief Justice, who is responsible for upholding these standards. The petitioner requests a free and fair trial within a reasonable time before the competent court.

In conclusion, the Application underscores the need to safeguard judicial systems from corruption or abuse. It is my humble submission that failure by the Supreme Judicial Council (SJC) to act decisively on this complaint will undermine people’s trust in those who preside over them, including my learned friend Mr Chief Justice Farooq, which shall occasion irreparable harm to litigants’ rights guarllllitigants’Constitution 1973 read together with fundamental freedoms enshrined therein binding upon State organs including judiciary itself being custodian thereof such as suitable to free fair trial within reasonable time before competent court. Therefore, I implore SJC to take these matters seriously and do justice.

The PTI leader has lodged a formal complaint against the Chief Justice of Islamabad High Court, Aamer Farooq.
