Founder of Pakistan Tehreek-e-Insaf (PTI) Imran Khan. Iddat Nikah, his partner Bushra Bibi’s attraction in opposition to the sentence in a wedding case, has been postponed for choice, with a purpose to be heard on May 29.
Shah Rukh Arjmand, the District and Sessions Judge of Islamabad, heard former Prime Minister Imran Khan and Bushra Bibi’s appeals against the sentence during the hearing of the marriage case.
PTI lawyers Usman Riyaz Gull and Raja Rizwan Abbasi, assistant advocate, appeared before the court on this occasion.
Evidence Presentation
The assistant advocate informed the court that Rizwan Abbasi had provided evidence that he did not have. The judge asked Usman Riyaz Gull, “You have also provided evidence; finalize yours.” Advocate Usman Riyaz Gull said, “I will take 10 to 15 minutes for my evidence.”
Judge Shah Rukh Arjmand remarked that Rizwan Abbasi should present his evidence before the court by one o’clock at any cost. Evidence must be provided through a video link by one o’clock.
Later, the court adjourned the hearing of the marriage case to one o’clock to decide on the appeals against the sentences.
Resumption of Hearing
The hearing resumed after the break, with PTI lawyers Usman Gull, Shoaib Shahin, Zahid Abbas, Niazullah Niazi, and prosecutor Adnan Ali appearing in the session court.
PTI leader Seemabiya Tahir, along with female PTI workers, crowded the courtroom.
Judge Shah Rukh Arjmand directed Usman Gull to complete his evidence, to which counsel Niazullah Niazi said that the evidence had already been completed and Rizwan Abbasi had provided proof.
Judge Shah Rukh Arjmand remarked that Usman Gull has only responded to the queries, and the evidence is complete.
Lawyer Usman Riyaz Gull’s Evidence
Lawyer Usman Riyaz Gull said that the complaint in the marriage case was filed late. Before this, a private complaint was lodged. Even then, Rizwan Abbasi was there.
Usman Riyaz Gull stated, “I want to tell the courtroom that the criticism turned into filed very late. In the first phase, an unknown individual filed a complaint, and in the second section, the identical challenge filed a grievance.”
He further said, “Both complaints had similar allegations against Imran Khan and Bushra Bibi. The complaint aimed only and only to target them politically.”
Usman Riyaz Gull said, “The complainant of the first complaint was a foreigner, Muhammad Haneef. Khawar Manika filed the second complaint, Iddat Nikah. The allegations against Imran Khan and Bushra Bibi were the same in both complaints.”
Lawyer Usman Riyaz Gull said that the complaint was filed for damage. Iddat Nikah, the reputation of PTI founder Bushra Bibi. During the trial, Mufti Saeed was asked several questions.
Usman Riyaz Gull said, “The purpose of asking questions to Mufti Saeed was to clarify Mufti Saeed’s role in the regime change of the 90s, which makes the role clear.”
Lawyer Usman Riyaz Gull continued, “Khawar Manika was arrested in a corruption case, filed a complaint, got bail, withdrew it, and filed a complaint again within 48 hours.”
He further said, “It was further said that Muhammad Haneef and Khawar Manika’s lawyers were Rizwan Abbasi, which indicates that the story was concocted. Such a procedure should be thrown into the garbage.”
Legal Proceedings with Usman Riyaz Gull
Usman Riyaz Gull informed the court that the prosecution has to prove its case under the law of evidence. The accusation was that the marriage took place before the completion of the ‘iddah’. The prosecution has to prove that marriage took place during the ‘iddah’.
He took the position that the prosecution relied on a document stating that divorce took place on that date. The document presented in court is a photocopy if the original document is not presented. It is not acceptable under the law.
Usman Riyaz Gull said that if the legal requirements are not fulfilled. Then this document cannot be placed on the judicial record. Lawyer Usman Riyaz Gull presented a guide on the documents presented in court.
Usman Gull said, “The photocopy presented regarding divorce was objected to, but the trial court rejected it. If there is doubt about the status of any document, how can it be used in the judicial record?”
Usman Riyaz Gull said, “Former prosecutor Rana Hasan had presented the facts of the case and was transferred the next day.”
Judge Shah Rukh Arjmand remarked, “What can you expect after this?” The court erupted in laughter at this sentence.
