Chief Justice Faez Isa’s Hearing on Senate Council Appeals

 

Chief Chief Justice Faez Isa’s will hear the Supreme Court’s complete 13-member bench appeal today (Thursday) regarding the Special Sessions of the Senate Council.

PTI’s Application for Party Status Chief Justice Faez Isa’s 

Pakistan Tehreek-e-Insaf (PTI) has also applied to become a party, while the Attorney General has submitted written submissions. PTI and Barrister Gohar Ali Khan’s position in the application filed is that PTI should be made a party in the Senate Council case. During the Senate Council’s appeals hearings, the Election Commission accused PTI, which is contrary to the facts. The Election Commission has deprived PTI of special seats in the Senate Council. And has divided those seats among other political parties. The Senate Council and PTI are eligible for particular seats. Special seats are unconstitutional for different political parties. The Senate Council is ready to provide a list for specific seats, but PTI has yet to list special seats.

Division of PTI Seats Among Other Parties

It will be against the public opinion to divide PTI seats among other political parties. PTI-supported candidates wanted to avoid becoming the other 13 political parties. There is an alliance between the Senate Council and PTI. The Chairman of the Senate Council supported PTI, and Hammad Raza was successful in Circle 104. Article 51 does not clarify that independent candidates should win more than one seat in political parties.

In his written submissions, the Attorney General stated that he recommended dismissing the Senate Council’s appeal and upholding the Peshawar High Court’s decision. He mentioned that political parties, if they contest elections, have the potential to win at least one seat and obtain special seats. Independent candidates have the option to join existing parties in Parliament, and the proposal includes a formula for removing special seats.
