Iddat Nikah Case | Sentences Upheld, Appeals Rejected

 

The appeals for suspending the sentences of former Prime Minister and PTI founder Imran Khan and his wife Bushra Bibi in the “Nikah during Iddat” case have been rejected. While the main appeals in the case are still under review.

According to details, the court reserved its decision on June 25 regarding the appeals for suspension of sentences filed by Imran Khan and his wife, Bushra Bibi, in the Iddat Nikah case.

Additional District Sessions Judge Afzal Majoka. While announcing the reserved decision. The appeals against the sentences in the Iddat Nikah case rejected the appeals for suspension of sentences filed by Imran Khan and Bushra Bibi. The Additional Sessions Judge issued a detailed 10-page verdict.

The unique verdict states that each appeal for suspension of sentences is rejected. The convicts aren’t entitled to bail beneath Section 426 for a bailable offense.

The verdict also states that, under the law, a female convict is also not entitled to bail. The court docket said that during the hearing of applications for suspension of sentences or launch on bail. The deserves of the case can not be mentioned. The sentences given to both convicts are neither short-term nor have they served a good-sized portion in their sentences.

Court Cites Precedent: Bail Only for Under-Trial Prisoners

The court referred to the Muhammad Riaz vs. State case in the Pakistan Criminal Law Journal. Which states that bail is the right of an under-trial prisoner, not a convicted one.

Imran Khan and Bushra Bibi had filed separate appeals to suspend their sentences in the Iddat Nikah case.

It is noteworthy that on November 25, 2023, Bushra Bibi’s former husband, Khawar Maneka, filed a criticism, and on February 3, 2024, Senior Civil Judge Qudratullah ruled in favor of Imran Khan and Bushra Bibi. The trial court docket sentenced both to 7 years in jail.

Sessions Judge Shah Rukh Arjumand excused himself from announcing the reserved decision on May 29. The Islamabad High Court had directed the Additional Sessions Judge to decide on suspending the sentences within ten days. The main appeals within a month.

The hearing of the main appeals in this case is scheduled for July 2.

It should be noted that former Prime Minister Imran Khan was imprisoned in Adiala Jail solely due to the sentence in the Iddat Nikah case. The PTI founder has already been acquitted in the Toshakhana and Cipher cases and is on bail in the 190 million pounds case and the cases filed on May 9 in Lahore, Rawalpindi, and Faisalabad.

The FIA has investigated the PTI founder twice in jail regarding an anti-state video tweet. No new case has been registered against the PTI founder regarding this matter. And no new case has been filed against him anywhere.
