Islamabad: The Islamabad District and Sessions Court has reserved its decision on the request to suspend the sentence in the marriage during the Iddat case involving Imran Khan, the founder of Pakistan Tehreek-e-Insaf (PTI), and Bushra Bibi. They will announce the decision on June 27 at 3 PM.
Additional District and Sessions Judge Muhammad Afzal Majoka heard the petitions, during which Imran Khan and Bibi’s Bibi’s lawyers, Barrister Salman Safdar, Khalid Yousaf Chaudhry, and Maneka’saneka’s lawyer Zahid Asif Chaudhry, appeared in court.
Barrister Safdar’safdar’s Arguments:
During the hearing, Bibi’s lawyer, Salman Safdar, questioned the court’s jurisdiction.
Lawyer Salman Safdar argued that parts of the alleged crime occurred in Lahore and Islamabad. As mentioned in the decision, Judge Afzal Majoka questioned why there was no indictment. The lawyer argued that they gave a sentence in a case that should not have been filed there.
Barrister Salman Safdar stated that he has been handling criminal cases for many years and found this case unique because both partners are involved with unclear allegations of fraud.
The lawyer mentioned the delayed filing of the complaint. Which occurred six years and 2,000 days after the alleged incident, expressing sympathy for the complainant’s unknown circumstances.
He also noted that the High Court has not yet issued a decision and that someone has filed an appeal in the Supreme Court. The cipher case points out that such a case involving a former Prime Minister and Foreign Minister is unprecedented.
He referred to the Toshakhana case, where the court suspended the sentence in just three minutes, expressing hope for a similar outcome. He acknowledged the challenges faced in Judge ShaArjumand’s court but commended the court’s court’s patience.
Lawyer Salman Safdar, representing a woman and mother who consistently complained, noted that Bushra Bibi had swelling in her feet when they last met.
At this point, Zahid Asif Advocate remarked that if they claim to have gone from Bani Gala to jail comfortably. They should stay there and not seek sentence suspension. In response, Barrister Salman Safdar pointed out that the Toshakhana case followed the cipher case. Where the opposing lawyer did not object to the suspension request.
He anticipated the same lack of objection from the opposing lawyer in the current case, referring to previous appeals. And suspension requests before Judge Shah Rukh Arjumand.
He emphasized the need for the same judge to decide the case, as detailed information was provided to the Islamabad High Court. Which is fully aware of the ongoing proceedings. He accused the complainant of repeatedly using delaying tactics.
Later, Bibi’s Bibi’s lawyer, Barrister Salman Safdar, read the IslamabaCourt’s decision in court.
After hearing Barrister Safdar’s arguments, the Islamabad District and Sessions Court disposed of the requests for an early hearing. And sentence suspension in the marriage during the Iddat case involving Imran Khan and Bushra Bibi.
