Drug Case: High Court Outraged by Unconfirmed Order Sheet

 

Chief Justice of the Lahore High Court, Aalia Neelum, has directed the CCPO (Capital City Police Officer) to present an inquiry report regarding the failure to record evidence in the bail plea of Ashfaq, an accused in a drug case.

Court’s Displeasure Over Unrecorded Witness Statements

The court expressed strong displeasure over the failure to record witness statements and the submission of an unauthenticated order sheet. Addressing CCPO Bilal Siddique Kamyana, Chief Justice Neelum questioned the discrepancy between his assurance that 90% of witnesses were appearing and the reality of their non-appearance despite court orders. She criticized the police for seemingly considering themselves above the law, noting that they had already been fined by the trial court. She suggested that if these officers could not attend court, they should be reassigned to duties where they would be more productive.

In response, CCPO Kamyana apologized and promised to address the issue. Chief Justice Neelum further instructed the installation of a biometric system in trial courts. Pointing out that witnesses often appear but their statements are not recorded. When questioned about the implications of this directive, the CCPO admitted that there were gaps in the system.

Financial Accountability and Public Trust

The court also raised concerns about the source of funds used to pay fines imposed on police officers for non-compliance with court appearances. The Chief Justice highlighted that if such issues persist in the courts, it reflects poorly on the police’s dealings with the public. She emphasized the need for a thorough investigation and report by the next hearing.

Inquiry Report and Future Hearing

The Chief Justice instructed CCPO Kamyana to conduct an inquiry and present the findings at the next hearing. She remarked that the presence of senior officers suggested a lack of control over their subordinates. The hearing was adjourned for two weeks, during which the court expects a comprehensive inquiry report.

Enhancements in Trial Court Procedures

To make the legal process more efficient and reliable, the Chief Justice has proposed a biometric system in trial courts. The goal of this system is to confirm that witnesses are present. That their statements are captured accurately and promptly. By using technology, the court hopes to minimize delays and maximize equity in its processes.

The Lahore High Court’s direction speaks to the need for accountability and efficiency within law enforcement, especially during trials. These issues will be further highlighted by an upcoming inquiry report which should also ensure justice for accused Ashfaq. Biometric systems can increase transparency while financial accountability can build public trust in judicial processes, according to the court. Two weeks from now there will be another hearing. Where it becomes clear whether or not these measures work as intended or if police officers are serious about upholding the rule of law.
