Contempt Case Overruled: NOC Suspension for PTI Rally Stands

The Islamabad High Court has dismissed a contempt of court petition filed against the cancellation of a PTI (Pakistan Tehreek-e-Insaf) rally allow. This decision got here after a series of criminal arguments and hearings revolving across the conduct of the Deputy Commissioner and the procedural actions of the district administration.

Court Proceedings

Justice Babar Sattar presided over the hearing concerning the cancellation of the PTI rally permit and the contempt of court case brought by the Tehreek-e-Tahaffuz-e-Aeen and the son of Aamir Mughal against the Deputy Commissioner of Islamabad.

PTI’s Lawyer Arguments

PTI lawyer Shoaib Shaheen said the police did now not file a case in opposition to him for an afternoon when they picked up Aamir Mughal from the workplace of the Deputy Commissioner. Justice Babar Sattar answered that a legal case must be taken to the applicable discussion board, indicating that this does not fall below contempt of court docket.

Discussion on NOC Cancellation

During the hearing on the contempt petition regarding the suspension of the rally’s No Objection Certificate (NOC), Shoaib Shaheen presented the written order from the Islamabad High Court. He highlighted that on July 4, the district administration notified the Islamabad High Court. Shaheen claimed that the Deputy Commissioner had sent him a notification at 1:30 AM on the night before the rally, suspending the permit. He also pointed out that the Chief Commissioner’s notification claimed that they had been invited to a meeting, yet they were not invited.

Court’s Remarks and Legal Guidance

Justice Babar Sattar remarked that if the Commissioner of Islamabad had suspended the order, the petitioner must challenge that specific order. Shaheen argued for punitive actions against the officials for their alleged collusion, but Justice Sattar emphasized that the court grounds its decisions in law, and only God knows the true intentions of individuals. He further explained that assessing the legality of the Chief Commissioner’s order would require a formal challenge.

Justice Sattar clarified that he could not proceed with contempt of court actions based on the current petition and urged Shoaib Shaheen to challenge the Chief Commissioner’s orders if he believed them to be unlawful. He reiterated that any decision regarding contempt of court must be based on clear legal grounds, not assumptions or unverified claims.

Ultimately, the Islamabad High Court dismissed the contempt of court petition filed by PTI. This decision shows the need for definite legal systems and the significance of questioning executive directives via accurate legal paths. This verdict by a court of law emphasizes following legal procedures and that the judiciary must serve justice according to recognized laws and regulations.
